A G E N D A



CITIZEN PARTICIPATION

The City Council is meeting as a legislative body to conduct the business of the City according to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL. Unless so ordered by the Mayor, citizen participation is limited to the following times and always within the prescribed rules of conduct for public input at meetings.

A) PUBLIC HEARINGS:  Public hearings are conducted so that the public affected by a proposal may have input into the decision.  During hearings, all affected residents will be given an opportunity to speak pursuant to the RULES OF PROCEDURE AND DECORUM OF THE CITY COUNCIL.

B) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS NOT ON THE AGENDA:

Any member of the public may speak at this time on any item NOT on the agenda. In consideration for the public attending the meeting for specific items on the agenda, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued under Other Business at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof.  No person other than members of the Council and the person having the floor shall be permitted to enter into any discussion without permission of the presiding officer.

Your participation, as prescribed by the Council's RULES, is welcomed and your cooperation is greatly appreciated.

4. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS NOT ON THE AGENDA

5. APPROVAL OF THE MAY 4, 2010, MEETING AGENDA

6. CONSENT AGENDA: Pursuant to Council rules, one motion, non-debatable, will approve the recommendation noted. Any member of the Council may ask for an item to be taken from the Consent Agenda for discussion and separate action. Such items removed from the Consent Agenda shall be considered immediately following approval of the balance of the Consent Agenda:

A. Motion to approve and order placed on file minutes of the regular City Council Meeting of 4/20/10, Reconvened Local Board of Appeal and Equalization Minutes of 4/20/10, and City Council Work Session of 4/13/10.

B. Motion to acknowledge receipt and placing on file minutes of the following Commissions and Boards:
-Human Rights Commission of 4/05/10
-Senior Commission of 4/12/10
-Parks, Recreation & Forestry of 4/27/10.

C. Motion to approve issuance of licenses from list dated 5/04/10.
D. Motion to proclaim May 17 through June 13, 2010, to be the Step To It Community Challenge in the City of Robbinsdale as a way to encourage resident’s participation in this walking program.

E. Motion to approve block party request for Kurt Coykendall, 3355 France Ave N & Mike Bergren, 3400 Grimes Ave N on Saturday, June 5, 2010, from 2-10 p.m. on 34th Ave between France and Grimes; and block party request for Jill & Denton Tyrel, 3812 Zenith Ave N, on June 18, 2010, from 5-10 p.m. on Zenith from 38th to 39th.

F. Motion to concur with the modified alley design for City Project 30405 and authorize the Public Works Director/City Engineer to approach the property owners at 4259 and 4265 Toledo Ave to obtain the necessary easements to permit the modified design.

G. Motion to acknowledge the RC Liquor Financial Reports for the months of February and March 2010.

H. Motion to approve the February and March payment for City credit card charges.

I. Motion to waive the reading and order the adoption of Resolution No. XXXX:  “A RESOLUTION APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT C00-3 TO ALLOW CLEARWIRE TO INSTALL ADDITIONAL ANTENNAS TO THE WATER TOWER #2 AT 3310 OAKDALE AVE N AND RELATED INFRASTRUCTURE ON THE SITE.”

J. Motion to waive the reading and order the adoption of Resolution No. XXXX:  “A RESOLUTION APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT C96-4 TO ALLOW CLEARWIRE TO INSTALL ADDITIONAL ANTENNAS TO THE WATER TOWER #1 AT 4133 HUBBARD AVE N AND RELATED INFRASTRUCTURE ON THE SITE.”

K. Motion to approve block party request for Redeemer Evangelical Lutheran church to hold the event on their parking lot on Saturday, May 15, 2010, from 10 a.m. to 3 p.m. with any appropriate licensing secured.

7. PRESENTATIONS
A. Presentation on Radio Club by members Jim Hammock and Tim Burd.

8. PUBLIC HEARING
*There are no public hearings scheduled.

9. OLD BUSINESS
A. First Reading Compost Regulation Update
• Motion to hold the first reading of Ordinance No. 10-XX:  “AN ORDINANCE AMENDING SECTION 605.04 OF THE CITY CODE PERTAINING TO RESIDENTIAL COMPOST OPERATIONS.”

B. West Broadway and 41st Ave – trial of Altered Traffic Controls
• Consider the additional trip generation information provided and determine whether to continue with the trial of altered traffic controls at the intersection of West Broadway and 41st Ave.

10. NEW BUSINESS
A. Whiz Bang Days Request for Additional Activities at Sanborn Park
• Discuss the vending request and provide direction to staff regarding conditions under which the additional vending spot would be authorized, if at all

B. Recommendation from Parks, Recreation & Forestry Commission relating to Lakeview Terrace Park Redevelopment
• Motion to accept the recommendation by the Parks, Recreation, and Forestry Commission to confirm that the Lakeview Terrace Park Redevelopment-Project No. 24909, include a Babe Ruth size baseball field.

C. Zoning Amendment Z10-2, rezoning properties in the downtown to DD-1
• Motion to hold the first reading of Ordinance No. 10-XX:  “AN ORDINANCE REZONING PROPERTIES IN THE DOWNTOWN FROM B-3 HIGHWAY COMMERCIAL AND B-4 COMMUNITY COMMERCIAL TO DD-1 DOWNTOWN DISTRICT.”

D. Participation in a Grant Submission for a Trial of Porous Pavement
• Motion to authorize the City to partner with the Shingle Creek Watershed commission to conduct a trial of porous pavement in a clay subgrade area on the paired intersections of Ewing Ave just north of 27th Ave and McNair Ave just north of 27th Ave, if the City of Plymouth cannot fulfill their obligations.

11. OTHER BUSINESS
A. Motion to approve disbursement requests for period ending 5/4/10.
A. City Manager Salary Adjustment
• Motion to approve 1.5% salary adjustment for the City Manager for the calendar year 2010, effective retroactively to January 1, 2010.
